Civil Division - Resuming Jury Trials

Jury trials will resume July 19, 2021, on a limited basis.  The health and safety of all is the Court's top priority.  Throughout the process of resuming jury trials, the Court will provide regular updates on its website, and Judges are encouraged to communicate with attorneys/litigants regarding the need for flexibility and the "standby" system for dates.

Beginning July 19, 2021 until further notice:

  • Only two jury trials per week will commence.
  • Jury selection will be conducted on Mondays and Wednesdays.
  • Voir dire will be conducted in CAYMC 301 - Jury Services Room.
  • The public will not be admitted to trial courtrooms. Interested individuals can view the proceedings on YouTube.
  • Multiple trials will be set for Monday and Wednesdays. ALL CASES SCHEDULED FOR TRIAL ARE ON STANDBY STATUS. ATTORNEYS SHOULD BE PREPARED TO PROCEED AS SCHEDULED.
  • Attorneys should email the Judge and JA IMMEDIATELY when a case scheduled for trial settles.
    • Older cases will generally receive priority. Cases with exigent circumstances may also be prioritized.
    • Do not assume your trial will be adjourned. If an adjournment is required, you must file a motion.
    • Communicate regularly with court staff, but also be aware court staff may not be able to tell you the likelihood your case will proceed to trial on the scheduled date.

Jury Trial COVID Protocols

The protocols are subject to revision based upon Michigan Supreme Court Administrative Orders and Wayne County Health Department directives.

  1. Masking and Social Distancing:
    • Face coverings are required at all times
    • Each juror will be provided a PPE kit containing a mask, face shield, gloves, and hand sanitizer. At the discretion of the judge presiding at the trial, jurors may remove masks when answering questions
    • Chair covers are also available
    • Social distancing will be maintained in all Court facilities (but not elevators)
    • To maintain social distancing, voir dire will take place only in Jury Services Room (301 CAYMC)
    • Plexiglass Partitions’ have been installed in all courtrooms.
    • Attorneys and all participants must stop by CAYMC 301 (Jury Assembly Room) daily for temperature check
  2. Masking and Social Distancing for Attorneys:
    • Face coverings are required at all times subject to the following exceptions:
      • They cannot be medically tolerated
      • At the discretion of the judge presiding over the trial:
        1. While attorneys are speaking
        2. The attorney is inaudible and temporary removal of the face covering is necessary to make an accurate record
    • 6 ft. social distancing must be maintained at all times
  3. Seating for Jurors in Courtrooms:
    • Facilities can assist with providing stickers indicating where jurors should sit
    • Jurors will be seated in the audience area
  4. Witnesses and Exhibits:
    • Chair covers will be available; the attorney calling the witness should hand the witness a chair cover
    • Witnesses will put on a face shield and remove their mask during testimony
    • The witness will dispose of the chair cover after testifying
    • Those handling exhibits (clerks, attorneys, witnesses) must wear gloves
    • Between witnesses, the witness microphone will be cleaned with sanitizing wipes
