Bridging the Gap in Mental Health

 

Third Circuit's Mental Health Court (MHC) is a 30 month Specialty Court program that services defendants who are seriously and persistently mentally ill, have a nonviolent history, and are charged with a nonviolent offense.  With judicial supervision, defendants voluntarily participate through conditional release in community mental health treatment and court approved programming.

 

As an expansion of services, the Mental Health Court, in conjunction with, our community partners Detroit Central City,  Detroit Wayne Mental Health Authority, and Wayne County Children & Family Services (Community Corrections Division) is hosting the 3 rd Annual Community Health Fair on Tuesday, July 28 from 10 a.m. to 3 p.m. at the historic Detroit Eastern Market, Shed #3.  The fair is free and open to the public.  The purpose of the Community Health Fair is to increase health awareness through education and prevention.

 

In other program news...this summer MHC participants will partner with the Greening of Detroit and receive training in urban farming at the Eastern Market Garden located within the City of Detroit.  The goal of this program is to reduce negative behavior by providing an outlet for participants to have a "hands-on" connection to the community with the hopes of inspiring a sense of commitment and belonging.

 

Another program benefit has been the utilization of the City of Detroit's William Walker Recreation Center on a weekly basis. Clients are able to participate in basketball, volleyball, swimming, low impact aerobics, arts and crafts, and ceramics.  They also have access to the computer lab to search for jobs.  MHC is also able to offer group therapy, have alumni meetings and host staff/client consumer meetings at the William Walker location.  MHC also refers clients for educational services and continues to use the services of the employment specialist. A Job Club has been formed where clients learn valuable resume preparation and interviewing skills.  A computer class curriculum is also being implemented.

 

Third Circuit's Mental Health Court is currently led by Presiding Judge Timothy M. Kenny and Program Coordinator Deborah Price.

 

Swift and Certain Justice

 

 

Third Circuit's Swift and Sure Sanctions Probation Program (SSSPP) is a 12 month intensive probation supervision program that targets high-risk felony offenders with a history of probation violations or failures.

 

The program is based on the principle that sanctions for probation violations are met with swift and certain jail time.  SSSPP is modeled after Hawaii's Opportunity Probation with Enforcement (HOPE) program, which studies have shown to be very successful in improving the rate of successful completion of probation among high-risk probationers.  The goal of the SSSPP is to improve probationer success by promptly imposing graduated sanctions, including small amounts of jail time, for probation violations.

 

Third Circuit's SSSPP was first implemented in 2011 as a pilot program.  Wayne County was one of only four counties in the state of Michigan that was chosen to pilot this program.  There are now 19 counties in Michigan with a Swift and Sure Sanctions Probation Program.

SSSPP probationers are closely monitored and subject to frequent random testing for drug and alcohol use.  In addition to reporting to their Michigan Department of Corrections (MDOC) Probation Officer, they are also required to report to their SSSPP Case Manager, as well as a treatment provider, if ordered.

 

The frequent reporting to multiple entities is what makes the supervision for SSSPP more intensive than standard probation.

In addition to working closely with MDOC, the SSSPP is partnered with the Wayne County Community Corrections for program placement and the Wayne County Sherriff's Office to assist with apprehension and housing.

July is the first full month of summer and the July 4th holiday will be widely celebrated with festivities.  As we celebrate the independence of our great nation this month, please take a moment to reflect upon the most famous words of the Declaration of Independence:  

 

"We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights; that among these are Life, Liberty, and the pursuit of Happiness."  

 

On our 239th birthday, what an incredible nation we are. Have a safe July 4th holiday and summer.

Chief  Judge Robert J. Colombo, Jr. was the Keynote speaker recognizing the 2015 Achievers, high school graduates who are in foster care.  "These are some of the most successful graduates in the city of Detroit." The ladies and gentlemen are on their way to various colleges and universities and many received partial and full scholarships.  Mr. Jason Fish, President of the Foster Care Alumni of America, encouraged the students to take their persistence, resilience, and enthusiasm and continue to soar. Thank you, Wayne County Department Health and Human Service Administration and the Park West Foundation for recognizing the 2015 Achievers, the future engineers, attorneys, teachers, and leaders. 

 

 

 

Same Charge...

Different Bond

Have you ever wondered how two people charged with the same crime, in the same jurisdiction, receives a different bond?  Or how two people that are co-defendants on a crime could possibly have differing bond amounts set?  And when either of these situations occurs, are they an indicator of a flawed or injustice system?  

Within the Third Judicial Circuit of Michigan, Pretrial Services has the responsibility of making bond recommendations on adult felony matters.  Pretrial Services' bond recommendations are based on the basic premises, the Bail Reform Act of 1966 and the Bail Reform Act of 1984.  The Bail Reform Act of 1966 focuses on the assurance that a defendant will return to court for future hearings, if released on a bond.  The Bail Reform Act of 1984 focuses on the potential danger a defendant poses to the community, if released on a bond.

Pretrial Services uses an evidence-based objective tool that was specifically created using data from Wayne County.  This tool can reasonable predict the defendant's future appearance probability and threat to the community.   The following thirteen (13) factors were identified to be predictors in Wayne County:

At least some College

Current charge is a weapons offense

At same address more than 4 years

Current charge felony class F to H

Once a defendant's score is totaled, they are classified as low risk, average risk, or highrisk.  A low risk defendant may have limited to no conditions in their bond.  An average risk defendant may have release conditions. There are no conditions or combination of conditions that can assure community safety or appearance in Court for high risk defendants.

 

Based on the aforementioned, two defendants with the same charge, in the same jurisdiction, can receive different bonds based on their individual risk score.  Also, two co-defendants on the same crime could possibly have different bond amounts set based on their individual risk scores.

The Michigan Legal Help Self-Help Center of Wayne County helps residents of Detroit and Wayne County who are unable to afford an attorney.   The Self-Help Center is now located in Smart Detroit, Suite 1300 of the Penobscot Building at 645 Griswold in Detroit.  
 
The Self-Help Center is now open Monday through Thursday from 9:00a.m. to 4:00p.m.
